1. Acceptance
These Terms of Service ("Terms") govern your use of the Frags app, this website and the services behind them (the "Service"), provided by Drexo LLC, a Texas limited liability company ("Frags," "we," "us"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
2. What Frags is — and isn't
Frags is a fragrance catalog, a place to keep your collection, a community of collectors, a price tracker and a trading floor between members.
Frags is not a store. The prices and availability shown are read from sellers' own public listings, and the Buy links take you to the seller. Any purchase is made with the seller, on their site, under their terms. Prices are informational: they can be out of date, misread, or changed by the seller at any moment, and a price in Frags is never an offer to sell or a promise that the seller will honor it. The app shows when each price was last read — confirm on the seller's site before you buy.
The AI features assist; they don't decide. Identify-by-photo and the advisor use an AI model and can be wrong. Treat their answers as suggestions.
The community is made by its members. Ratings, votes, comments, classifications and listings are other people's opinions and statements, not ours.
3. Eligibility and accounts
- You must be at least 13 years old, and old enough to enter a binding agreement where you live, to use the Service. Frags is offered in the United States.
- You are responsible for what happens under your account and for keeping your sign-in private. Tell us at once if you think someone else has it.
- Give us accurate information and keep it current. One person, one account.
- To list bottles or propose trades you must first confirm your email address (or have signed in with Apple).
- You can delete your account at any time in the app (Settings, then Delete account).
4. Frags Pro: billing and cancellation
- Frags has a free plan and one paid plan, Frags Pro, $4.99 per month (USD), which adds trading, the trade watchlist, price tracking with alerts, live Buy prices, and the AI features.
- Two ways to subscribe, one subscription. In the app, Pro is sold through the Apple App Store and charged to your Apple ID; on this website, Pro is sold by Drexo LLC and charged to your card through Stripe. An account can hold only one Pro subscription at a time — if you already have one, manage it where you bought it.
- Renewal. Pro renews automatically every month until you cancel. App Store subscriptions renew under Apple's rules (cancel at least 24 hours before the period ends to avoid the next charge). Web subscriptions renew on the same day each month until cancelled.
- Cancelling. For an App Store subscription, open your iPhone's Settings, then your name, then Subscriptions. For a web subscription, sign in on your account page and use Manage subscription. Deleting the app does not cancel a subscription. Cancelling stops the next renewal; you keep Pro until the end of the period you've already paid for.
- Refunds. Payments are not refunded in part for unused time. Refunds for App Store purchases are decided by Apple under its policies. For web purchases, we refund where the law requires it and, at our discretion, for billing mistakes — email support@fragsapp.com.
- Changes to price or plan. We may change the price or what Pro includes for future periods. We'll give notice as the law and the App Store require, and a change never affects a period you've already paid for.
- Taxes may be added where they apply.
5. Trading between members
Frags lets members list bottles and arrange swaps with each other. Frags connects traders but is not a party to any trade. We do not verify items or their authenticity, handle shipping or meetups, hold money, or process payments between members. Trades are at your own risk, and Frags is not responsible for losses, damages or disputes arising from a trade. Use ratings, photos and chat to judge your trading partner, and report abuse.
When you trade you also agree that:
- You own what you list, describe it honestly (including fill level and condition), and don't list counterfeits, samples decanted from bottles you don't own, or anything you may not legally transfer.
- You are responsible for any shipping, including the rules that apply to shipping fragrance (most perfumes are flammable and carriers restrict how they travel), and for any taxes or duties.
- Any dispute about a trade is between you and the other member. We may, but are not required to, step in, remove listings, or restrict accounts.
- Ratings you leave must reflect a trade you actually completed.
6. Your content
You own what you post — comments, photos, listings, messages, profile details. You give Frags a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce and moderate that content so the Service can work, for as long as it stays on the Service. Content you make public (comments, ratings, a public profile, a listing) is visible to other members. You promise you have the right to post what you post, and that it doesn't infringe anyone's rights or break the law.
New comments and photos pass through an automated screen and may be reviewed by a person. We may remove content that breaks these Terms or is reported, and we're not obliged to keep or return removed content.
7. Acceptable use
Don't:
- harass, threaten, impersonate or deceive other members, or post content that is hateful, sexual, violent or otherwise abusive;
- use the Service for anything unlawful, or to break a seller's or a carrier's terms;
- scrape, copy or redistribute the catalog, prices or other members' content, or access the Service by any means other than the app and this website;
- try to disrupt, overload, reverse engineer or gain unauthorized access to the Service or its infrastructure;
- resell, sublicense or commercially exploit the Service;
- run more than one account, or an account for someone else.
We may suspend or close accounts that break these rules or threaten the safety or integrity of the Service.
8. Intellectual property and independence
The Service — its software, design, logos, the perfume overviews we write, and the way the catalog is organized — belongs to Drexo LLC and is protected by intellectual-property law. We grant you a limited, non-exclusive, non-transferable, revocable license to use it for personal, non-commercial purposes.
Frags is an independent tool. It is not affiliated with, endorsed by, or sponsored by any fragrance house, brand, retailer or marketplace that appears in it. Perfume names, bottle images, logos, trademarks and company names displayed in the Service belong to their owners and are used only to identify the products and the sellers' listings. Their appearance implies no affiliation with, endorsement of, or sponsorship of Frags. If you hold rights in something you believe is shown improperly, email support@fragsapp.com and we'll review it promptly.
9. Third-party services
The Service relies on and links to services we don't control: the App Store and Apple's sign-in, Stripe for web payments, the sellers whose listings we read, and the providers listed in the Privacy Policy. We're not responsible for their content, availability or practices. Your use of the App Store is also governed by Apple's terms, including Apple's standard end-user license, and of Stripe's checkout by Stripe's terms.
10. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't warrant that the Service will be uninterrupted, error-free or timely; that a price shown is current or correct; that a price drop will be detected or an alert delivered; that the AI features will be accurate; or that any member, item or trade is what it appears to be.
11. Limitation of liability
To the fullest extent the law allows, Drexo LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or opportunities (including a purchase made at a price other than the one shown, a missed drop, or a trade that went wrong), arising out of or related to the Service. Our total liability for all claims will not exceed the greater of one hundred US dollars (USD $100) and the amount you paid us in the twelve months before the claim. Some jurisdictions don't allow some of these limits, so some may not apply to you.
12. Indemnification
You agree to indemnify and hold Drexo LLC harmless from claims, losses and expenses (including reasonable attorneys' fees) arising from your content, your trades, your misuse of the Service or your breach of these Terms, to the extent the law allows.
13. Termination
You can stop using the Service and delete your account at any time. We may suspend or end your access if you break these Terms or where necessary to protect the Service or its members. Sections that by their nature should survive — including your content license for content that remains, intellectual property, disclaimers, limitation of liability, indemnification and dispute resolution — survive termination.
14. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules.
Binding individual arbitration. Except for the matters listed under "Exceptions," you and Drexo LLC agree that any dispute, claim or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration on an individual basis, rather than in court. The arbitration is administered by the American Arbitration Association under its Consumer Arbitration Rules then in effect, and judgment on the award may be entered in any court of competent jurisdiction. The arbitration will be held in Travis County, Texas, or conducted by phone, video or written submissions, unless the law requires an in-person hearing elsewhere.
Class-action waiver. Each of us may bring claims against the other only in an individual capacity, not as a plaintiff or class member in any class, collective, consolidated or representative action. The arbitrator may not consolidate more than one person's claims or preside over any form of class or representative proceeding.
Exceptions. Either party may bring an individual claim in small-claims court if it qualifies, and either party may seek injunctive or other equitable relief in court for intellectual-property infringement or unauthorized access to the Service.
30-day opt-out. You may opt out of this arbitration agreement by emailing support@fragsapp.com within 30 days of first accepting these Terms, with your name and a statement that you decline arbitration. Opting out doesn't affect any other part of these Terms.
Nothing here limits non-waivable consumer rights you have under the laws of your state of residence.
15. Changes
We may update these Terms. We'll post the new version here and update the date at the top; for material changes we'll also tell you in the app or by email. Using the Service after a change takes effect means you accept it.
